Not anymore..  On my T40 w/ SuSE 8.2 (ships with patched 2.4.20 kernel):

# cat /proc/cpuinfo  | sed -n "/cpu MHz\|bogo/p"
cpu MHz         : 1598.665
bogomips        : 3191.60

# cat /proc/cpufreq
          minimum CPU frequency  -  maximum CPU frequency  -  policy
CPU  0       199833 kHz ( 12 %)  -    1598665 kHz (100 %)  - 
performance

# echo "0%40%100%powersave" > /proc/cpufreq

cat /proc/cpuinfo  | sed -n "/cpu MHz\|bogo/p"
