I got exactly that rc9 patch.

 And it applied cleanly. The point is it still (even with fix) hanging my 
laptop.

I can share my 2.6.25 kernel tree or compiled image if you'd like. It has 
unofficial centrino undervoltage patch, tp_smapi and that broken 
hdaps_protect patch.
