I don't know, but 2.6.10-rc3 should apply cleanly to plain 2.6.9
source.

A 2.6.9-mm1 patch should be applied to 2.6.9 kernel source. A
2.6.10-rc2-mm4 patch should be applied to 2.6.10-rc2 kernel source.
