http://www.freedos.org/jhall/tp-r40/ , among other search results when
you Google "linux thinkpad r40", says that Redhat 9 or Mandrake 9.1
works pretty well. I don't think you'd have problems with anything
that includes X 4.3.0, since the R40 has a Radeon 7500 and that's
reasonably well-supported. http://www.beezmo.com/Linux.htm says there
are problems with suspend-to-disk corrupting the display, though...
fixable by using the VESA X server, but who wants to do that? I
suppose you could "chvt 1" before suspending to disk....

I'm not sure what you mean when you say "problem with EEPROM". There
are some Thinkpads where you should *not* install or use the lm-sensors
package; this package provides hardware monitoring of CPU temperatures
and fan speed, and it can cause severe problems on Thinkpad hardware.
Don't install the package and you should be fine. HTH,
