This is fixed in the new branch of madwifi called madwifi-ng,
inevitably.  See new home: www.madwifi.org.

Bear in mind the README: you now need to initiate a "wlanconfig create"
command to create the ath0 interface from wifi0 before starting it up.
But scanning without disruption now works.
