Not necessarily.  In order to go Chapter 11, they have to show a viable
plan, else they could be forced into Ch 7.  Also, there's the matter of
how much they owe Novell for the conversion of the royalties.  This has
to be settled before they proceed with the bankruptcy plan, so that
other creditors are not given Novell's money.  The money in question has
already been ruled to be illegally diverted.  The only question
remaining is how much.  As this money is not SCO's it cannot be part of
any bankruptcy settlement.  Also, there are indications of possible
bankruptcy fraud, along with telling different things to the judge in
the two cases and also to the SEC vs what's told in the court cases. 
There's also the little matter of SCO telling the court there was no
danger of bankruptcy, encouraging the judge to rule against placing that
money in a trust.  In short there are lots of things for which the SCO
principals can be held personally responsible.  Check out Groklaw for
